Privacy Policy — DeepSpace

This privacy policy (“Privacy Policy”) governs how we, “DeepSpace,” “we,” “our,” or “us” use, collect, and store Personal Data we collect or receive from or about you (“you”) such as in the following use cases:

When you browse or visit our website, deepsp.com.ua (“Website”);

When you make use of, or interact with, our Website:

When you contact us to request a demo or for any other inquiry;

When you contact us;

When we process your job application; and

When you download material from the Website.

When you attend a marketing event, exchange business cards with us, or otherwise provide us with your personal data for marketing purposes.

When we use the personal data of our customers, prospects, or service providers (e.g., contact details).

When you make use of, or interact with, our web application, mobile software applications or the DeepSpace plugins (including AI Presenters for PowerPoint) or our application programming interface software that is called or queried under an API Call (collectively, the “Software”):

When you create an account and when you log in;

When you upload photos, text, video and/or audio, for creating video animations (“Animation(s)”) and/or receiving an output;

When you connect to get and/or share your Animations; and

When you upgrade to become a Paying User.

Please read this Privacy Policy carefully so you can understand our practices and your rights in relation to personal data. “Personal Data” means any information that can be used, alone or together with other data, to uniquely identify any living human being and any information deemed as Personally Identifiable Information by privacy laws, including (but not limited to) email address, phone number, mailing address, and other contact information as well as IP addresses, device identifiers, and other unique identifiers. Please note that this is a master privacy policy and some of its provisions only apply to individuals in certain jurisdictions. For example, the legal basis in the table below is only relevant to GDPR-protected individuals.

“Applicative Data” means any data submitted to the Software for processing, including (but not limited to) usage data such as features used, time spent, interaction data, system logs, referral data, content interactions and creation (including voice cloning), and performance data. Nothing in this Privacy Policy is intended to limit your statutory rights. You further acknowledge that DeepSpace is unaware of Personal Data, if any, that you may include as part of the Applicative Data uploaded for processing, and DeepSpace advises you to follow Privacy by Design methodologies and to minimize—if not eliminate—providing any unnecessary Personal Data.

This Privacy Policy may be updated from time to time; please check back periodically for the latest version. If we implement significant changes to the use of your Personal Data in a manner different from that stated at the time of collection, we will notify you by posting a notice on our Website and/or the Software or by other means.

1. What personal data we collect, why we collect it, and how it is used
(I) When you browse or visit our Website

Specific Personal Data we collect: Cookies; IP address; analytics data (e.g., pages viewed); log files.
Why: To operate and improve our Website; remember preferences and settings; personalize your experience; security; monitor usage.

Consequences of not providing data: Certain Website features may not be available.

Why: To facilitate a conversation; provide a demo; send marketing communications.

Consequences: We may be unable to converse, provide a demo, or send marketing communications.

(2) When you contact us
Data: Full name; email address; company name; job title; phone number; any other data you provide.
Why: To process and respond to your request; send marketing communications.
Legal basis (GDPR only): Legitimate interest; performance of a contract or pre-contract steps; Consent (marketing).
Consequences: We may be unable to respond or send marketing communications.

(3) When we process your job application
Data: Full name; email address; phone number; CV/Resume; any other data you provide (which we may also receive from recruitment agencies).
Why: To assess you as a candidate; analyze your application; communicate with you.
Legal basis (GDPR only): Performance of a contract or pre-contract steps (employment); Legitimate interest (candidate assessment).
Consequences: We may be unable to assess or communicate with you.

(III) When you attend a marketing event or provide personal data for marketing purposes

Data: Full name; email address; company name; job title; phone number; any other data you provide.
Why: To establish a business connection; send marketing communications.
Legal basis (GDPR only): Legitimate interest; Consent (marketing).
Consequences: We may be unable to connect or send marketing communications.

(IV) When we use the personal data of our customers, prospects or service providers

Data: Full name; email address; physical address; phone number; company details; payment information; any other data you provide.
Why: To provide our products and services; perform the applicable agreement; communicate with you.
Legal basis (GDPR only): Performance of a contract; compliance with legal obligations (e.g., tax, bookkeeping); Legitimate interest (contract-related communications).
Consequences: We may be unable to provide services, perform agreements, or communicate.

(V) When you interact with us on our social media profiles

Data: Full name; email address; social media channel; any other data you provide.
Why: To respond to your requests; send marketing communications.

Consequences: We may be unable to respond or send marketing communications.

(VI) When you make use of, or interact with, the Software

(1) When you create an account and when you log in
Data: Full name; email address; SSO-provided credentials (e.g., profile thumbnail, if applicable); location data; device and/or browser; job title; any other info you provide.
Why: To create and access your account; understand our users; enable registered-user features; send notifications and marketing collateral.
Legal basis (GDPR only): Performance of a contract or pre-contract steps; Legitimate interest (account creation).
Consequences: We may be unable to provide products and services or perform the agreement.

(2) When you upload photos, text and/or audio to create Animations and/or receive an output
Data: Photos; text (which may include Personal Data); audio (which may include Personal Data).
Why: With your permission, to access camera, microphone, and gallery so you can create Animations and/or receive outputs. You are responsible for obtaining all necessary approvals and consents for third-party content you upload.
Legal basis (GDPR only): Consent (device access); Performance of a contract or pre-contract steps; Legitimate interest (enabling creation of Animations/outputs). You may withdraw consent at any time.
Consequences: We may be unable to provide products and services or perform the agreement.

(3) When you connect to get and/or share your Animation(s)
Data: Full name; email address; SSO-provided credentials; location data; device and/or browser; job title; any other info you provide.
Why: To allow viewing, downloading, and sharing of Animations.
Legal basis (GDPR only): Performance of a contract or pre-contract steps; Legitimate interest (enable download/share).
Consequences: We may be unable to provide products and services or perform the agreement.

(4) When you upgrade to become a Paying User
Data: Payment information (credit card last 4 digits, expiration date, and card provider name).
Why: To process your payments.

Consequences: We may be unable to provide products and services or perform the agreement.

General note: Some Personal Data may be used for detecting, preventing, and prosecuting fraud or other illegal activity, identifying and repairing errors, conducting audits, and for security purposes. Personal Data may also be used to comply with applicable laws, with investigations by relevant authorities, for law-enforcement purposes, and/or to exercise or defend legal claims. In certain cases, we may anonymize or de-identify your Personal Data and further use it for internal and external purposes, including improving the services and for research. “Anonymous Information” means information that does not enable identification of an individual (e.g., aggregated usage). We may use Anonymous Information and/or disclose it to third parties without restriction. Use of a personal email address to access the Software is not mandated. We recommend using a role-based email connected with credits (e.g., studio@company.com
) or another address that does not include a personal name. The Software does not interpret or analyze Personal Data, and does not modify any Personal Data uploaded to it. Please minimize the provision of Personal Data unless absolutely necessary for your intended result, including when using any synthetic faces.

2. How we protect and retain your personal data

Security. We implement appropriate technical, organizational, and security measures designed to protect your Personal Data. However, no system is 100% secure. Please protect your device, network, and credentials appropriately.

Retention. Personal Data is stored until we proactively delete it or you send a valid deletion request. We may retain data longer where required by legal, regulatory, tax, or accounting requirements; to maintain accurate records of dealings; or where litigation is reasonably anticipated. 3. How we share your personal data

We may share Personal Data as follows:

Service providers:

Cloud hosting providers;

Website and content management platforms/tools to operate the Website and/or Software;

Email, marketing, and CRM providers (e.g., Salesforce or HubSpot) and similar tools;

Analytics companies to help us understand and analyze information collected under this policy (including text and/or photos).

Business partners and affiliates with whom we jointly offer products or services.

Regulators and authorities as required to comply with laws and lawful requests.

Corporate transactions: If we sell or transfer some or all of our business, shares, or assets, we may disclose Personal Data to the actual or potential purchaser.

Mergers, acquisitions, insolvency: We may transfer or disclose Personal Data in connection with such events.

With your consent (e.g., for optional services or features).

4. Additional information regarding transfers of personal data

Storage. We store Personal Data with providers such as Salesforce, HubSpot, and Zendesk (Website), and AWS in Oregon, USA (Software and Applicative Data).

External transfers. Where we transfer Personal Data outside the EU/EEA, we generally obtain contractual commitments to protect it. When DeepSpace engages in such transfers, it relies on Adequacy Decisions or Standard Contractual Clauses and monitors transfer circumstances to ensure protection essentially equivalent to that guaranteed by the GDPR.

5. Your privacy rights. How to delete your account

Rights (subject to exemptions/derogations and, in some cases, to GDPR-protected individuals):

Access the Personal Data we hold about you;

Rectify inaccurate or misleading data;

Request erasure/deletion (subject to legal obligations and claims);

Object to or request restriction of processing;

Data portability;

Object to profiling;

Withdraw consent at any time (processing prior to withdrawal remains lawful);

Request details regarding transfers outside the EEA (subject to redactions for confidentiality);

Lodge a complaint with your local data protection authority. We ask that you attempt to resolve issues with us first.

. You may use an authorized agent with written permission. We may verify your identity before fulfilling requests and may charge a fee where permitted by law (e.g., manifestly unfounded or excessive requests). If your request adversely affects others’ rights or we are legally entitled to handle it differently, we will address it to the maximum extent permitted by law.

Deleting your account: You may delete your account via the DeepSpace products or by emailing space.corporation@proton.me
. After termination, the association between your account and stored Personal Data will no longer be accessible through your account. Public activity before deletion may remain stored and publicly accessible, given the nature of certain services.

Scope: The rights above apply to our registered customers using the Software. Our policy is to respect these rights wherever we can associate data with an identified data subject, coordinated with you or the relevant customer.

6. Use by children

We do not offer products or services for use by children and do not knowingly collect Personal Data from individuals under eighteen (18). 7. Interaction with third-party products

You may interact with third-party websites, mobile applications, and services not owned or controlled by us (“Third Party Services”). We are not responsible for their privacy practices or content. Third Party Services may collect Personal Data; please review their terms and privacy policies.

8. Log files

We use log files. Information may include IP addresses, browser type, Internet Service Provider (ISP), date/time stamps, referring/exit pages, clicked pages, and other information your browser sends. We use such information to analyze trends, administer the Website and/or Software, track movement, and gather demographic information.
